Sky Mobile TV Service Terms

This text (together with any documents referred to in it) sets out the terms and conditions on which we provide Sky Mobile TV. Please read these terms and conditions carefully before using Sky Mobile TV.
By proceeding to use the Sky Mobile TV service, you are accepting these terms. You should print a copy of these terms and conditions from the O2 website for future reference.
Information About Us
Sky Mobile TV is provided by British Sky Broadcasting Limited. We are registered in England and Wales under company number (registered number 02906991) and have our registered office and main trading address at Grant Way, Isleworth, Middlesex TW7 5QD. Our VAT number is 440 6274 67.

Information about Sky Mobile TV
- Sky Mobile TV allows you to watch a simultaneous stream of live Sky TV channels on your mobile phone.
- You can watch all or any of Sky Sports 1, Sky Sports 2, Sky Sports 3, Sky Sports Xtra, Sky Sports News, Sky News, At The Races, CNN, by purchasing a pass to our Sky Mobile TV pack for either 24 hours or a 30 day Pass (the terms for each of these are set out below).
- To watch Sky Mobile TV content on your mobile phone, you will need a compatible 3G mobile phone with continuous network coverage.
- Data charges may apply and, if applied by O2 at any time. will be additional to the cost of your Sky Mobile TV Pass.
Using Sky Mobile TV
- You can only use Sky Mobile TV if you are resident in the Republic of Ireland.
- Sky Mobile TV content is provided for non-commercial use in the Republic of Ireland only and you will not be able to transfer content to any other device.
- Our available content changes regularly and we reserve the right to change our range of available content at any time.
- You must not copy, reproduce, republish, post, broadcast, transmit or make Sky Mobile TV content available to the public or authorise or assist any one else to do so.
Passes
- Sky Mobile TV Passes allow you to watch your chosen channels over your choice of either a 24-hour or a 30-day Pass period in return for a Pass fee. Pass fees are payable in advance and will be collected with your next bill or immediately if you are a pay as you go customer.
- At the end of your first and each subsequent monthly Pass period, we will automatically renew your Pass and collect your Pass payments from your next bill or immediately if you are a pre pay customer, unless you cancel your Pass before the next Pass period begins.
- Where we offer a free promotional period, you can cancel any free promotional Pass (or other free offer) without charge by cancelling your Pass before the free promotional period ends. 4.4 Other than as described above, you can end your Pass at any time but the change will not take effect until your current Pass period ends and we will not reimburse any of your Pass fee in that case.
- Once chosen, you can view the channel(s) as much as you want to for the remainder of the Pass period subject to O2’s Fair Use Policy. Stopping or restarting a channel does not extend the available time for viewing.
Prices
- All of our prices are set out on the O2 website and will change from time to time.
- Our prices include VAT and any equivalent sales tax that is applicable. We will not be obliged to honour prices that are the result of obvious and unmistakeable errors and which that could reasonably have been recognised by you as a mis-pricing.
Service Interuptions & Termination
- We may suspend all or part of the Sky Mobile TV service for technical reasons or where necessary for operational reasons. Not all programmes shown on the full Sky television versions of these channels will be available on Sky Mobile TV.
- We may suspend your use of the Sky Mobile TV service where any payments remain outstanding, such as where your credit card has not been authorised for the purposes of your Pass
- We may suspend or terminate your access to all or any part of the Sky Mobile TV service at any time if you breach these terms. We will not refund any payments you have made if we terminate your access to all or any part of the Sky Mobile TV service because of any breach by you of these terms
- Sky Mobile TV is made available to you over O2’s mobile network and under an agreement between us and O2. If your agreement with O2 ends, and we can no longer provide Sky Mobile TV to you, we will refund any Pass payments relating to the remainder of your Pass period. The service may also be interrupted by any issues affecting O2 network availability.
- If you want to cancel your Sky Mobile TV Pass, go to the “My O2 TV” section on the O2TV Service and click on “Pass Management”.

Our Liability
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation or for any matter that we cannot exclude or limit as a matter of law.
- Other than as described at 7.1, we shall not be liable for any financial loss, loss of information, damage to (or corruption of) data or any indirect loss or damage of any kind, whether caused by tort (including negligence), breach of contract or:
- interruption or delay in the performance of the Sky Mobile TV caused by matters outside our reasonable control (including but not limited to any interruption to the data service provided by O2 and allowing you to watch Sky Mobile TV);
- errors, bugs or viruses present in or arising from your use of Sky Mobile TV that are not directly caused by or attributable to us;
- failure to follow our reasonable instructions or regulations for using the Sky Mobile TV;
- us, our employees and/or agents:
- where there is no breach of a legal duty of care owed to you by us or any of our employees or agents; or
- where the loss or damage is not a reasonably foreseeable result of any breach of a legal duty of care owed to you by us, any of our employees or agents.
- incompatibility with any software, hardware or material on your mobile phone;
- any content supplied by third parties or any product or service advertised, promoted, offered or sold by third parties for use in connection with Sky Mobile TV; or
- any other matter outside our reasonable control.
- While we will make efforts to ensure that the information contained in or on Sky Mobile TV is as accurate as possible, we do not accept any liability and make no representations or warranties in relation to the accuracy or completeness of any information contained on Sky Mobile TV.
- These limitations do not affect your statutory rights. If you require any advice on your legal rights, you can refer to http://www.irishconsumer.ie.

Your Personal Information
By becoming a customer you agree that any member of the British Sky Broadcasting group may use and share, within that group, the information you provide and other information we hold about you for account management and, unless you have told us otherwise, for market research, sending you periodic newsletters about your services and the marketing of group and third parties’ products and services including for a reasonable period after you cease to be a Sky Mobile TV customer. This may include contacting you for marketing or market research purposes by post, telephone, email or SMS unless you tell us you don’t want to be contacted for such purposes in any of these ways by calling us on 0818 762 846 or sending an email to MySky@bskyb.com.
We may also share such information with credit reference and fraud prevention services for use in credit decisions and for fraud detection and prevention purposes. If false or inaccurate information is provided and fraud is identified, the details will be passed to fraud prevention agencies. Law enforcement agencies may access and use this information. We and other organisations may also access and use this information to prevent fraud and money laundering, for example, when: checking details on applications for credit and credit related or other facilities; managing credit and credit related accounts or facilities; recovering debt; checking details on proposals and claims for all types of insurance; or checking details of job applications and employees. We and other organisations may access and use from other countries the information recorded by fraud prevention agencies. Please contact us by emailing us at MySky@bskyb.com if you want to receive details of the relevant fraud prevention agencies. We may also share your information with other companies for debt recovery purposes.
In addition, we may provide information to third parties for the purposes of preventing or detecting crime or for the purpose of safeguarding national security. We also provide information when required to do so by law (for example under a court order) or in response to properly made demands in accordance with legislative powers. Disclosures made will be in accordance with applicable data protection legislation.

Third Parties and Advertising
We may display, or allow other third parties to display, advertising and other information in Sky Mobile TV content or any element of the Sky Mobile TV service. Unless we expressly state otherwise, your correspondence or dealings with, or participation in promotions of, advertisers found on or through Sky Mobile TV are solely between you and those advertisers.

General
- We may change our terms or Pass fees at any time, though we will announce that via O2 Mobile TV and/or the O2 website and give you at least 30 days notice where the change will have an adverse affect on you.
- Providing that it does not adversely affect your rights, we may transfer our rights and obligations under the terms to one or more third parties during your time as a Sky Mobile TV customer.
- Your Sky Mobile TV Pass is personal to you and you may not transfer either it or your rights or obligations under these terms to anyone else.
- All or any part of any term of this agreement that is found to be unfair or unenforceable will be treated as deleted and the remainder of the terms will continue to govern our each of our respective obligations going forward.
- Your use of Sky Mobile TV is governed by the law of the Republic of Ireland and any disputes can be dealt with by the courts in the Republic of Ireland.
